American workers deserve better!
Background
For more than a century, employers who have franchisees or who employ contractors are often just as much “the boss” to workers as the company they oversee. By employing a contractor or setting terms for franchisees, these companies set working conditions, dictate the terms of employment, and often decide who stays on the job and who doesn’t.
The so-called “joint employment” standard has been used over the years so that disreputable corporations can’t skirt the law simply by pushing liability onto subcontractors or staffing agencies.
Real-life examples of this “who’s the boss” accountability problem abound: A temporary worker on his first day on the job at a Bacardi bottling plant in Florida died when he was crushed in a machine; Bacardi said it was the temp agency’s sole responsibility but never trained the temp agency or the worker.
H.R. 3441 would set an impossibly-high standard with which to hold bad corporations accountable for decisions that directly harm workers and would give shady employers a convenient loophole to allow them to dodge any and all accountability when they violate labor standards on the job.
The bill would not help small businesses. It would insulate giant corporations, including huge franchisors like McDonald’s, from liability.
